Agreement to Terms
By accessing or using madak.ca (the "Site") or purchasing any product from MADAK ("we," "us," "our," or "MADAK"), you agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and any additional terms referenced herein. If you do not agree with any part of these Terms, please do not use the Site or place an order.

Eligibility
You must be at least 18 years old, or the age of majority in your province or territory of residence, to place an order on this Site. By using the Site, you represent that you meet this requirement and that any information you provide us is accurate and current.

Definitions
"Site" refers to madak.ca and all related pages. "Products" refers to the MADAK silicone scalp scrubber and any other items we offer for sale. "You" and "your" refer to the person accessing the Site or placing an order. "Order" refers to any request to purchase Products submitted through the Site.

Use of Our Website
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by any third party. You may not attempt to gain unauthorized access to any portion of the Site, interfere with its security features, scrape or harvest data using automated means, or introduce viruses, malware, or other harmful code.

Account Registration
Some features of the Site, such as checkout, may allow or require you to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Notify us immediately of any unauthorized use.

Products, Descriptions & Pricing
We strive to ensure that all product descriptions, images, and pricing on the Site are accurate. However, we do not warrant that product descriptions or other content are error-free. Colours may vary slightly due to display settings. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

Orders & Acceptance
When you place an order through the Site, you are making an offer to purchase the selected Products subject to these Terms. We reserve the right to accept or decline any order for any reason, including product availability, errors in pricing or product information, or suspected fraud. An order is not accepted until you receive a confirmation email from us.

Payment & Billing
All prices on the Site are listed in Canadian dollars (CAD) unless otherwise stated. We accept the payment methods indicated at checkout. By providing payment information, you represent that you are authorized to use the payment method and authorize us (or our third-party payment processor) to charge the full order amount, including applicable taxes and shipping, to that payment method.

Promotions, Discounts & Gift Cards
From time to time we may offer promotional codes, discounts, or gift cards. Promotional offers are valid only for the period stated, cannot be combined unless explicitly permitted, and may be modified or withdrawn at any time without notice. Gift cards are non-refundable and cannot be redeemed for cash except where required by law.

Taxes
Applicable federal and provincial sales taxes (including GST/HST/PST as applicable) will be calculated and added to your order total at checkout based on your shipping address, in accordance with Canadian tax law.

Shipping & Delivery
We offer Canada-wide shipping, with free shipping on orders over $35 CAD (before tax), as indicated on the Site. Estimated delivery times are provided for convenience only and are not guaranteed; delays may occur due to carrier issues, weather, customs, or other factors beyond our control. Risk of loss and title for Products pass to you upon delivery to the carrier.

Order Cancellations & Changes
We aim to process orders quickly, so if you need to cancel or change an order, please contact us as soon as possible. Once an order has been processed for shipment, we may be unable to modify or cancel it, and you will need to arrange a return in accordance with our returns policy below.

Returns, Refunds & Our Happiness Guarantee
We stand behind our products with a 30-day happiness guarantee. If you are not satisfied with your MADAK scalp scrubber within 30 days of delivery, contact us to arrange a return or exchange, subject to the conditions communicated at the time. Refunds are issued to the original payment method once the return is received and inspected, where applicable. Shipping costs may be non-refundable except where the return is due to our error or a defective product.

Product Warranty & Disclaimer
Our Products are intended for external cosmetic use on the scalp only. Except as expressly stated on the Site or required by applicable Canadian consumer protection law, Products are provided "as is" without warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose. Nothing in these Terms limits any non-excludable statutory warranty or consumer right you may have under applicable law.

Prohibited Conduct
In addition to other restrictions in these Terms, you agree not to: resell or commercially exploit Products purchased from the Site without our written permission; submit false or misleading information when placing an order; use the Site to violate any applicable law or regulation; or impersonate any person or entity in connection with your use of the Site.

Reviews & User-Generated Content
If you submit a product review, photo, testimonial, or other content to us ("User Content"), you grant MADAK a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, display, and distribute that User Content in connection with marketing and operating the Site. You represent that your User Content is your own original work and does not violate any third party's rights. We reserve the right to remove any User Content at our discretion.

Intellectual Property
All content on the Site, including text, graphics, logos, images, product designs, and the MADAK name and branding, is the property of MADAK or its licensors and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by MADAK. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. You access any linked third-party site at your own risk.
LEGAL TERMS

Limitation of Liability
To the fullest extent permitted by applicable law, MADAK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or Products. Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the Products giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Canadian law.

Indemnification
You agree to indemnify and hold harmless MADAK, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site or Products.

Force Majeure
MADAK will not be liable for any failure or delay in performance under these Terms resulting from causes beyond our reasonable control, including acts of God, natural disaster, labour disputes, supply chain disruptions, carrier delays, or governmental action.

Dispute Resolution & Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, and we encourage you to contact us first so we can try to resolve any concern informally.

Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.

Entire Agreement & Waiver
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and MADAK regarding the Site and supersede any prior agreements. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, offerings, or applicable law. The "Last updated" date at the top of this page indicates when these Terms were last revised. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms.
